Salt Spring trustees send Baker Beach comments to province

The Local Trust Committee directed staff to forward public correspondence and a petition about the Crown lease application as additional information.

Staff will send public correspondence and a petition about the Baker Beach Area Crown Lease Application to the Province, after the Salt Spring Island Local Trust Committee passed a motion directing them to do so. The committee also asked the Islands Trust Executive Committee to review the Crown lease referral process and directed staff to provide future Crown land lease referrals with enough time for consideration and add them to the applications report.[1]

During public questions, Regional Planning Manager Chris Hutton said the committee’s earlier response to the Crown referral indicated the proposal generally met Islands Trust policies and regulations, except that it was within a Shoreline Development Permit Area. He said four development permit applications were under review and had not been issued; staff could approve, deny or refer them to the committee.[1]

Hutton said the development permit process relied on reports from qualified professionals hired by applicants. He said staff could recommend a third-party review if they had reason to believe a study was inadequate to professional standards.[2]

A project applicant told the meeting that the applicants had reached out to First Nations stakeholders and extended the public comment period beyond 90 days. Hutton said staff had received comments and questions from First Nations, while the Crown had the duty to consult in the lease application process.[1]

The committee also approved a rezoning application to proceed for a proposed full-time rental cottage at 200 Collins Road. It asked staff to prepare a draft bylaw, seek input from the Islands Trust Conservancy Board and other applicable agencies and First Nations, and proceed with public notification.[1]
